AL-KAFI #913: BUSKING TO RAISE FUND FOR BUILDING TAHFIZ INSTITUTION

Question:

Assalamualaikum Dato’ Seri Mufti. We are in the effort of building a Tahfiz institution (private) which will progress through public funding. The funding method is through busking, which will be done by singing in the street. The fund will be divided into three parts; 60% for the buskers, 30% for the tahfiz institution and 10% for the principal of the tahfiz institution. My question here is, is this method of funding and the money division permissible? Hope for some explanation. Thank you.

Answer:

Alhamdulillah, praise and thanks to Allah for the countless blessings He has blessed us all with. Blessings and salutations to the prophet Muhammad PBUH, his family, companions and all those that follow his teachings to the day of judgement.

Based on the above issue, donation is a praised act in our religion. Allah SWT ask His servants to help each other towards goodness. This is clearly stated in the Quran:

فَاسْتَبِقُوا الْخَيْرَاتِ

“So race to [all that is] good,”

Surah Al-Baqarah (148)

Answering the above question, busking is a street performance or show done by a group of buskers. The ruling for busking is the same as the ruling for music. According to Syeikh Prof. Dr Yusuf al-Qaradhawi: “Islam permits singing as long as there is no element of ma’siah, foul words, obscene lyrics and elements which drive people away of the guided path. It is permissible if there is no usage of musical instruments which increase someone’s sexual desires.” (Refer: Halal dan Haram di dalam Islam, page 564-566)

The same is stated in the decision made by the Fatwa Committee of National Council for Islamic Religious Affairs Malaysia’s 2nd Muzakarah held on 12th – 13th May 1981 which states the following:

  1. Songs with good lyrics, not obscene, not offensive, not promoting sins, no mixing between men and women and not leading to fitnah are permissible (harus).
  2. Conversely, songs with foul lyrics, obscene, offensive, lead to ma’siah, mixing of men and women and lead to fitnah, then they are prohibited (haram).
  3. Band which drives people away from the remembrance of Allah is prohibited (haram).
  4. Listening to music and band performance is permissible on the conditions of having good lyrics, not obscene, not offensive, not promoting sins, no mixing between men and women and not leading to fitnah; and
  5. Singing to increase the spirit of jihad is permissible

Suggestions and Advice

Here, we would like to give some suggestions and advice to be considered to improve the money division:

First: The amount of money funded shall be divided by giving more portion for the tahfiz students compared to the others. The reason said, the purpose of this funding is to build the tahfiz institution only. Hence, the purpose of people donating shall be fulfilled. For example, 60% for the tahfiz institution which includes related management cost and 40% is for the buskers.

Second: If you intend to do division of money according to what is stated before, then the purpose of the funding should be announced in detail. This means, it is best to not announce that the funding is specifically for the tahfiz institution. This is to prevent uneasiness in the heart of the donors when they discover that the funding does not go to where they expect it to.

CONCLUSION

Pertaining this issue, we are of the opinion that the ruling for raising fund by busking is permissible as long as the activity does not contradict the syarak. It is indeed still under the main purpose of the funding which is to build a tahfiz institution. It also coincides with an Islamic legal maxim:

الأمور بمقاصدها

“Matters are determined by intention”

Therefore, we suggest that those involved in this funding to reanalyze the percentage of the money division, so that it will be in congruent with the main purpose of the funding.
